High Court Justice overturns SDP five's acquittal

This should come as no surprise to seasoned observers of local politics.

High Court Judge Choo Han Teck has overturned District Judge John Ng's decision to acquit five activists for conducting a procession in 2007. Mr Choo ordered that the matter return to DJ Ng for conviction and sentencing.

Broad definitions make for bad laws

Principal Senior State Counsel, Mr Bala Reddy, asked the High Court to broadly define a "procession" to "include even peaceful or small-scale processions" in the AGC's appeal against the decision to acquit five SDP members of procession charges.

Mr Bala yesterday argued that the law did not allow any procession of five or more people in any public place to demonstrate support for, or opposition to, the views or activities of any person; to publicise a cause or campaign; or to mark or commemorate any event.

Attorney-General's Chambers appeals SDP acquittal decision

I had previously wrote about that decision, and the AGC has decided to appeal that decision.

Justice Choo Han Teck said he needed more time to consider the submissions from the respondents and the prosecution, which is represented by the Attorney-General's Chambers (AGC). This means he will decide at a later date whether to dismiss the appeal or to allow the appeal against the five.

Five opposition members acquitted of "procession" charges

I will be very surprised if there is no appeal filed by the DPP, but for now, let us rejoice in the decision.

The five were cleared of charges of taking part in a procession without a valid permit on Sept 16, 2007. If convicted, they would have faced a fine of up to $1,000 for the offence under the Miscellaneous Offences (Public Order & Nuisance) Act.
